CLARIFICATION NO. 4, answers to questions received on 10 April 2023

 Question 
1. Please clarify if we can provide you with
a manufacturer's authorization in the form
of a DAF (Distributor Authorization
Form) submitted by that distributor.
Is this type of authorization acceptable to
you: (DAF)?

Answer

According to Clause 3.1 e) Section III –
Evaluation and Qualification Criteria of the bidding
document:
“(e)Manufacturer’s authorization: A Bidder
who does not manufacture an item/s where a
manufacturer authorization is required in
accordance with BDS ITB 17.2 (a), the Bidder
shall provide evidence of being duly authorized
by a manufacturer (Manufacturer’s
Authorization Form, Section IV, Bidding
Forms), meeting the criteria in (d) (i) and (ii)
above, to supply the Goods;
(f) A bidder who does not manufacture an item/s
where a manufacturer authorization is not required
in accordance with BDS ITB 17.2 (a), the bidder
shall submit documentation on, its status as a
supplier, to the satisfaction of the Purchaser (e.g.
authorized dealer/ distributor of the items)”.
According to Paragraph “3. Technical
Specifications” of Section VII – “Schedule of
Requirements” of the Bidding document:
“Manufacturer/Distributor Authorizations have to
be provided for all specified Equipment”. If a bidder
offers goods from Distributor with a Distributor’s
authorization form instead of a Manufacturer’s
Authorization form, the bidder should also submit
the documental evidence proving that in the frames
of the current bidding process, the Distributor is
providing goods from the official Manufacturer
(proving document submitted by a Manufacturer
to the Distributor).
